When you visit the Site, our servers automatically record information that your browser sends whenever you visit a website ("Log Data" ). This Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the web-pages you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider the IP address will be different every time you log on. When you register with SILKFAIR, our servers record information regarding your IP address, in which would be used as part of your user profile. The IP address is also used to approximate the city, state and country location of your user ID for the purpose of mapping feedbacks and location of stores and members for the benefit of the overall community. The IP registered can be re-calibrated by the user at user’s discretion by selecting the recalibration option in user’s account profile. This geolocation function is solely for the benefit of establishing trust within the SILKFAIR community in helping potential buyers/seller to identify who and where (city, state and country) feedbacks/comments are generated, and to help buyer/seller visualize the city/state/country of the party that the buyer/seller is engaging or potentially engage.

Credit card information supplied by buyer to seller is stored privately encrypted by the seller. SILKFAIR does not access the credit card information exchanged between buyer and seller. SILKFAIR stores buyer’s credit card information in the system and the information is privately encrypted by the buyer’s data encryption key, and this storage is made for the convenience of the buyer and to enhance the purchasing experience. SILKFAIR does not access the buyer’s credit card information.

Credit card information supplied by the buyer using payment services such as Google Checkout and PayPal are supplied directly to the payment services by the buyer, and that sensitive information is not stored in SILKFAIR.

Credit card information supplied by seller to SILKFAIR for the purpose of fee payment in association with the operation of the store within SILKFAIR and related system, are stored by SILKFAIR using multiple layers of strong encryption.

We use your personal information to facilitate the services you request. We use your personal information in the file we maintain about you, and other information we obtain from your current and past activities on the Site to: resolve disputes; troubleshoot problems; help promote safe trading; collect fees owed; measure consumer interest in the services provided by us, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us and SILKFAIR community against error, fraud and other criminal activity; enforce our Terms of Use Agreement; and as otherwise described to you at the time of collection. At times, we may look across multiple users to identify problems or resolve disputes, and in particular we may examine your personal information to identify users using multiple User IDs or aliases. We may compare and review your personal information for errors, omissions and for accuracy.

If you choose to list an item for sale on the Site or open a credit account, or otherwise provide us with your financial information, we use your address and billing information to bill you and provide associated support.

You agree that we may use personal information about you to improve our marketing and promotional efforts, to analyze site usage, improve the Site's content and product offerings, and customize the Site's content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Site.

You agree that we may use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, administrative notices, product offerings, and communications relevant to your use of the Site. By accepting the Terms of Use Agreement and Privacy Policy, you expressly agree to receive this information. If you do not wish to receive these communications, we encourage you to opt out of the receipt of certain communications in your profile. You may make changes to your profile at any time.

When you post a message, your SILKFAIR ID or alias is visible to other users. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. SILKFAIR may be required to disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the SILKFAIR Terms of Use. SILKFAIR may disclose personally identifiable information to parties at SILKFAIR's sole discretion if SILKFAIR believes it is necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, SILKFAIR may disclose information such as name, street address, city, state, zip code, country, phone number, email address and company name. SILKFAIR may share aggregated demographic information with business partners.

SILKFAIR will not rent, sell, or share personal information about you with nonaffiliated parties except as specified in this Privacy Policy to provide products or services you have requested or when SILKFAIR has your permission. It may be necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of SILKFAIR's Terms of Use, as specified in this Privacy Policy or as otherwise required by law. SILKFAIR will transfer information about you if SILKFAIR is acquired by or merged with another company. In this event, SILKFAIR will notify you by email or by putting a prominent notice on the SILKFAIR web site before information about you is transferred and becomes subject to a different privacy policy.

As part of the buying and selling process, you may obtain another SILKFAIR user's email address, shipping address and/or other information. Pursuant to SILKFAIR's Terms of Use, you have a limited license to use this information. This information should only be used for SILKFAIR-related communications or for SILKFAIR-facilitated transactions. SILKFAIR has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any SILKFAIR user to your email or physical mail list.

Without limiting the above, in an effort to respect your privacy and SILKFAIR's ability to keep the community free from bad actors, SILKFAIR will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order, legal process, or substantially similar legal procedure, except when SILKFAIR believes in good faith that the disclosure of information is necessary to protect SILKFAIR's rights, prevent imminent physical harm or financial loss, or to report suspected illegal activity.

SERVICE PROVIDERS - We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.

COMPLIANCE WITH LAWS AND LAW ENFORCEMENT - SILKFAIR cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), to protect the property and rights of SILKFAIR or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

BUSINESS TRANSFERS - SILKFAIR may sell, transfer or otherwise share some or all of its assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of your information differs materially from that set forth in this Privacy Policy.

THIRD PARTIES - Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information SILKFAIR collects from you. If you disclose your information to others, whether they are buyers or sellers on SILKFAIR or throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. SILKFAIR does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. SILKFAIR encourages you to ask questions before you disclose your personal information to others.

Access and control over most personal information on SILKFAIR is readily available through the registered user’s account profile section. SILKFAIR users may modify or delete any of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to deactivate their SILKFAIR account may do so by sending an email request to support@silkfair.com. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of SILKFAIR.

Where you make use of the communication features of the service to share information with other individuals on SILKFAIR, however, (e.g., sending a personal message to another SILKFAIR user) you generally cannot remove such communications.
